A Kaplan man serving a life sentence without parole for the 2010 stabbing death of a pizza delivery driver has been granted a new trial in Lafayette.

(KADN) - A Kaplan man serving a life sentence without parole for the 2010 stabbing death of a pizza delivery driver has been granted a new trial in Lafayette.

In an opinion released Wednesday, the Third Circuit Court of Appeal cited the U.S. Supreme Court's 2019 ruling on non-unanimous juries in granting Aaron Richards a new trial.

Richards was convicted 10-2 by a Lafayette jury in 2017, but his case was pending before the U.S. Supreme Court when the high court issued its ruling finding convictions by non-unanimous juries to be unconstitutional.

No re-trial date has been set for Richards, who was convicted in the ambush death of delivery driver Timothy Falgout in Youngsville in March 2010.
